TRADEMARK
The Core of Intellectual and Industrial Property
What is a Trademark?
A trademark consists of distinctive signs such as words, letters, numbers, shapes, colors, sounds, or combinations thereof, which serve to differentiate the goods or services of one enterprise from those of others.
What is Trademark Registration?
Trademark registration is the official recording of a trademark with an official body (TÜRKPATENT in Türkiye) for the purpose of its legal protection. This process grants the person or entity owning the trademark an exclusive right to use it for specific goods or services.
Why Should I Get Trademark Registration?
1. Provides Legal Protection
The registered trademark is legally recorded in your name. It grants the right to prevent others from using the same or similar trademarks. You can defend your rights through official channels against counterfeiters.
2. Brand Reputation and Trust
Consumers have more trust in registered trademarks. This positively impacts brand loyalty and commercial reputation. It demonstrates that your business is managed with a serious and professional structure.
3. Assurance Against Unfair Competition
Thanks to trademark registration, you can initiate legal proceedings against unauthorized use, copying, or imitation of your brand.
4. Competitive Advantage
It protects you against those who wish to enter the market with similar names and logos. It ensures uniqueness and exclusivity in the market, putting you ahead of your competitors.
5. Commercial Value
A registered trademark can be licensed, assigned (sold), or converted into a franchise system. It turns your brand into a tangible financial asset.
6. Foundation for International Protection
A trademark registered in Türkiye can serve as the basis for international trademark applications, making it protectable in other countries.
7. Foundation for Corporate Identity
All elements representing your brand, from your logo to your packaging design, are placed on a legal foundation thanks to registration.
8. Incentives and Supports
Institutions such as the Ministry of Commerce or KOSGEB may provide financial support and incentives for registered trademarks for international registration, promotion, and fair activities.
| Contribution | Description |
|---|---|
| Legal Assurance | Protects your business from risks. |
| Brand Reputation | Increases customer loyalty and trust. |
| Commercial Flexibility | Creates opportunities for licensing, assignment, and attracting investments through the brand. |
| Market Strength | Provides an advantage against similar brands. |
| Global Expansion | A prerequisite for entering the global market. |
How to Obtain Trademark Registration?
Trademark Selection and Class Selection
The first step is to determine the trademark you wish to register. The groups of products or services (classes) where your brand will be used must be selected. Türkiye uses the Nice Classification system, consisting of 45 classes. These classes determine the scope of protection of the registered trademark.
Search (Similar Trademark Check)
Before applying, it is recommended to check if the trademark or its similar counterparts have been registered previously. This search reduces the risk of rejection, saves time, and prevents unnecessary costs.
Application
The application is filed online with TÜRKPATENT. It is recommended to seek support from expert trademark attorneys to avoid loss of rights.
Formal Examination and Publication Process
TÜRKPATENT checks for compliance. If found suitable, the trademark is published in the Official Trademark Bulletin for 2 months. During this period, third parties may file oppositions.
Opposition Process
If an opposition is filed within the period, the applicant can submit a counter-opinion within 1 month. TÜRKPATENT makes the final decision. If no opposition is filed, the process proceeds towards registration. It is recommended that the process be meticulously monitored by expert attorneys.
Registration
For applications that do not face opposition or where the opposition process results favorably, a trademark registration decision is issued by TÜRKPATENT. The Trademark Registration Certificate is then sent to the applicant.
Protection Period
The protection period is 10 years from the date of application and can be renewed an unlimited number of times every 10 years.
How long does it take to obtain trademark registration?
The process in Türkiye varies according to the institution and oppositions:
- Application without opposition: Average 6 - 8 months (Shortest 4-5 months, Longest 12 months)
- Application with opposition / prolonged examination: Average 9 - 14 months
Points to Consider
- Conduct a Preliminary Search: A comprehensive database search is essential.
- Distinctiveness: General and descriptive terms should be avoided.
- Correct Classification: The correct products/services must be selected from the 45 classes.
- Deadlines and Monitoring: TÜRKPATENT notifications must be responded to within the deadline.
- Renewal: Renewal must be done at the end of the 10-year protection period.
- Professional Support: Working with an expert trademark attorney eliminates risks.
Most Common Mistakes
- Applying directly without conducting a search.
- Trying to trademark purely sectoral/descriptive words.
- Selecting product/service classes incompletely or incorrectly.
- Providing missing official documents and fees.
- Failing to respond to official letters/oppositions from the Institution.
- Forgetting trademark renewal dates.
- Attempting to manage the process alone or with non-experts.
International Trademark Registration
Trademark protection is territorial, meaning a trademark registered in one country is not automatically protected in others. You secure your export and import activities through international trademark registration. In exports made with unregistered trademarks, the risk of goods being seized at customs is significant.
| System | Scope | Advantages | Points to Consider |
|---|---|---|---|
| Madrid System (via WIPO) |
130+ Countries | Multiple countries with a single application, centralized system, cost and time advantages. | Dependent on the basic trademark in Türkiye for the first 5 years. Cancellation affects the system. |
| EU Trademark (EUIPO) |
27 EU Countries | Valid protection across the European Union with a single procedure. | A serious rejection/opposition in one country may affect the entire Union. |
| National Application | Selected Country | Direct protection specific to the target country's law. | Requires separate languages, separate attorneys, and separate costs for each country. |
