INDUSTRIAL DESIGN
Legal Protection for Appearance and Aesthetics
What is Industrial Design?
It refers to the appearance of a product, its aesthetic features, and outward form. Elements regarding appearance such as lines, shape, texture, and ornamentation fall within the scope of registration. It protects visual perception rather than function.
What is Design Registration?
It is the official protection of a product's outward appearance before TÜRKPATENT. With registration, the unauthorized production, sale, or import of the product is prevented for a specific period.
Why Should I Get Design Registration?
Protection Against Imitations
The right holder obtains legal protection against imitations. It prevents similar designs from entering the market.
Commercial Value and Trust
Registration increases the commercial value of the design, ensuring an environment of trust for investors and business partners.
Additional Source of Income
The right holder can turn their design directly into a source of income through licensing or assignment.
Market Positioning
It makes products distinguishable from competitors and significantly increases marketing power.
How Does the Registration Process Work?
Preparation
The phase where clear and correctly selected visuals of the design and its technical description are professionally prepared.
Application
The official process begins with the submission of the file to TÜRKPATENT. A formal examination is conducted by the Institution.
Publication
Designs found formally suitable are published in the bulletin and opened to oppositions from third parties.
Registration
If no opposition occurs or if an opposition is rejected, the registration becomes final and the official certificate is delivered.
Cumulative Protection Strategy
Multiple protection is the protection of different elements of a single product with more than one intellectual property right.
Trademark: Product name and logo are protected.
Patent: Technical operation and function are protected.
Design: External appearance and aesthetics are protected.
Copyright: Artistic/Work nature is protected.
Important Note: Cumulative protection may not be possible in every case. Since a design application carries the nature of "disclosure to the public" upon publication, a strategic sequence must be followed so as not to compromise the patent novelty criterion.
How Long Does it Take?
Industrial design registration in Türkiye results in an average of 6 to 12 months.
Novelty Criterion
For a design to be eligible for registration, it must not have been presented to the public anywhere in the world before the application.
Points to Consider
- Novelty Criterion: It is essential that the design has not been previously presented to the public anywhere in the world.
- Clear Visuals: Visuals are the sole element determining the scope of the application; they must be correctly selected.
- Isolation: Visuals should not include elements outside the scope of registration, such as shadows or backgrounds.
- Renewal: The registration period must be regularly monitored and renewed.
Most Common Mistakes
- Applying for designs that have already been presented to the public or displayed at fairs.
- Using incomplete or incorrect visuals that blur the boundaries of protection.
- Not effectively conducting competitor monitoring and legal actions after registration.
- Ignoring international protection needs or the cumulative strategy.
